Judge Susan van Keulen of the US District Court for the Northern District of California gave the present decision. The case concerned the collection of confidential data by Google of Chrome users in Incognito mode. Google claims to provide extensive evidence of its innocence, as users are aware that confidential information is collected when using private mode. In addition, the company’s lawyers claim that they have provided and are ready to present any necessary evidence to the court.

The lawsuit has been pending since May 2022, following a class action lawsuit filed against Google by “several million” US users for illegally collecting data in the “Incognito” mode of the company’s native browser.

One of the components of the current court order is the prohibition of Google from supporting its position with the testimonies of some of its employees who have witnessed a breach of user privacy.

In addition, Judge Van Keulen ordered Google to pay the plaintiffs’ costs of bringing experts to the case and pay a fine of $79,000.
