The lawyers of Elon Musk they won a small but significant victory in the lawsuit against Twitter. The billionaire had asked Twitter to share the data of more than 22 employees, including some low-ranking employees, with his lawyers.

After hearing the parties, the judge agreed to force Twitter to provide the data — emails, messages and more — of just one employee: Kayvon Beykpourthe former number 1 in the division consumer product of the social network.

Last April, Elon Musk submitted a proposal to buy 100% of Twitter’s shares. The operation would have cost $44 billion, partly financed by the banks and some of the billionaire’s partners.

A lot has happened in the months since the offer was made, including the collapse of the US stock market. For example, Netflix has lost more than 70% of its value since the beginning of the year and the market has not been kind to Twitter either. In other words, Elon Musk would have had to pay a significantly higher price than the fair market value of the social network.

The billionaire then went on to accuse Twitter of lying about the real number of bot accounts on the social network: according to the company, they are only 5% of active accounts per day, while for Musk that would be at least three times that. In July, after a tug-of-war that lasted several weeks, Musk announced that he had withdrawn his proposal to buy the social network, accusing Twitter of violating the terms of the agreement.

In response, Twitter sued Elon Musk, hoping the Delaware court would force him to honor his obligations and buy 100% of the company. The trial begins on October 17. Musk’s lawyers will have the difficult task of proving that Twitter actually hindered the success of the acquisition, leaving the billionaire unable to verify the validity of the official data on the number of active bot and spam accounts on the social network.
