Considering the doubts raised by the interpretation of Article 179 of Law No. 2294 of last May 19, which changes the deadlines for technical-mechanical and pollutant emission inspections for the RTM-EC of new private vehicles, The Ministry of Transport determined the conditions to comply with this procedure in a circular.

The article in question reduced the RTM-EC period for ‘new’ cars, which should be valid for vehicles registered after the Law came into force, that is, after May this year, from six years to five years.

However, traffic authorities began to apply this rule to registered vehicles in previous years, and this caused vehicle owners to complain. In most cases they were unable to process transfers because they needed existing RTM, when in fact they were covered for the first six years.

For this reason, the Ministry of Transport has issued a circular informing drivers that, as of October 20, all private service vehicles other than motorcycles must undergo the first technical inspection, the mechanics and the pollutant emissions of your vehicle. Upon completion of the fifth year counted from the date of registration,.

However, vehicles registered and first registered between 20 May 2017 and 19 May 2018 are exempt from this measure, with an initial period of six years starting from the date of registration.

“Those vehicles had an expectation of inspection, and what is called retrospectivity in the law, so that vehicle segment will be inspected after it has completed its sixth year of being registered or first registered.” he explained. Ministry of Transport.
