Megafon applied to the EU court for a lawsuit to remove the company’s sanctions. The operator filed a corresponding lawsuit, the defendant is the Council of the European Union, writes Kommersant.
As an argument, Megafon cites the provisions of European legislation. The plaintiffs point out that the Council of the EU violated four of those rules when it took decisions on sanctions against the Russian operator.
In particular, the company’s representatives indicate that the rights of defense in court were violated. The plaintiffs also claimed that the sanctions were imposed without giving reasons. Furthermore, according to the plaintiff, such restrictions are initially illegal, since they were the result of errors in the evaluation of MegaFon’s activities. The statement of claim also highlights the violation by the Council of the EU of the principle of proportionality.
The Russian operator was under EU sanctions in February 2023. Due to the restrictions, the company cannot receive dual-use goods. In April this year, Megafon was already under US blocking sanctions.
