The Institute of the Commissioner for the Protection of the Rights of Entrepreneurs under the Presidency has produced a special report “Key Business Issues in the Context of Sanctions and Structural Transformation in 2023”. Commercial offers:
  • introduce state reimbursement for household appliances and household appliances with Russian operating systems; certificates for products of light industry, for food products of local producers – for low-income citizens. These measures are necessary to support consumer demand alongside those already in place, such as tourist cashback, Russian car cashback, tax breaks for home purchases, fitness subscriptions and medical services.
  • to form a regulatory framework for the circulation of cryptocurrencies in the Russian Federation for settlements with foreign counterparties. To do this, foresee both the possibility of using digital currency for external settlements, as well as the creation of an internal system of mutual settlement or compensation, even with the issuance of special digital currencies for these purposes. It is proposed to determine the status of such transactions and the taxation of cryptocurrencies as an asset class with “explanatory work” by the tax service.
  • legally fix the signs of interdependence and accountability of taxpayers, that is, signs of “business fragmentation”. Business representatives propose to codify the concept of “business fragmentation” and establish its criteria (illegal tax savings and the presence of a person who controls all the subjects of the scheme, etc.).
  • exclude from the application by law enforcement and tax authorities excessive measures that restrict the rights of entrepreneurs to freely dispose of property and money during the period of tax audits. It is proposed to amend the tax legislation, providing that the decision on additional assessment and tax collection enters into force only after the expiration of the statutory term for judicial appeal, and the enforcement measures are applied only after the entry into force of the tax authority’s decision on liquidation and additional collection.
  • of Single Tax Accounts (UNT), to which companies and tax authorities have been transferred since the beginning of 2023, to simplify the work with Single Tax Payment (UTP) and cancel the declarative procedure for their identification. And also consider setting multiple dates for reporting to avoid peak administration load within companies.

In March, the Russian Union of Industrialists and Entrepreneurs (RSPP) proposed measures to reduce criminal and administrative pressure on companies. It is proposed to analyze the economic composition of crimes in the Criminal Code of the Russian Federation and transfer some of them to the administrative level.
