The Federal Antimonopoly Service (FAS) of the Russian Federation has opened a case against the Telegram channel “My Nizhny Novgorod”, Durov Code reports with reference to the document on the initiation of the case.
As follows from the definition, on September 12, specialists from Nizhny Novgorod OFAS Russia checked the channel “My Nizhny Novgorod”, the number of subscribers of which exceeds 86 thousand. It turned out that from September 2 to 12, 16 posts were published. without the “Advertising” mark.
FAS made the following decisions:
- Initiate proceedings for violation of the Federal Law “On Advertising”;
- Recognize the founder of the Telegram channel as the person whose actions contain signs of infringement (the person has been identified by the FAS) and the “advertising consumer F” as the applicant;
- Set the case for hearing on October 16.
From September 1, administrative liability applies for distributing Internet advertising without a token (a unique code assigned by the advertising data operator) or violating the requirements for its placement.
According to the updated advertising law, organizations and individuals must transfer data about their advertising campaigns to a unified accounting system. Individuals for violations face a fine of 30 to 100 thousand rubles, officials – from 100 to 200 thousand rubles, legal entities – from 200 to 500 thousand rubles.
A previous survey showed that one in ten business owners are unaware of the fines for failing to label online advertising.
