The business association “Business Russia” sent proposals to the presidential administration with changes to the Criminal Code of the Russian Federation and the Code of Criminal Procedure of the Russian Federation, Kommersant writes with reference to the document. Among the proposals of Business Russia is the abolition of the use of the article on the organization of a criminal community (article 220 of the Criminal Code of the Russian Federation) in relation to businessmen.
The business association also proposed changing the approach to recording “business” crimes. According to the community, static currently exists only for those items that are certainly related to business: fraud, illegal entrepreneurship, creation of a legal entity through dolls, etc.
At the same time, there are no statistics on the number of prosecutions of entrepreneurs for common criminal offenses (for example, parts 1-4 of article 159 of the Criminal Code of the Russian Federation).
Among other proposals, in the Criminal Code of the Russian Federation there is a special provision on fraud in VAT refunds. The investigation of the case through ordinary criminal proceedings ends with the arrest of the businessman and the failure to comply with the deadlines for the return of the seized assets, which generates risks of bankruptcy, the business community added.
