The Moscow Arbitration Court did not hear the cassation appeal of the co-founder of the CloudPayments payment service, Dmitry Spiridonov, as can be seen from the file of arbitration cases. The complaint was filed against the decision of the court of appeal in the conflict between Spiridonov and Tinkoff.

“The decision of the Moscow Arbitration Court of May 17, 2022 and the decision of the Ninth Arbitration Court of Appeal of August 14, 2023 in case No. A40-249282/2022 remain unchanged, the cassation appeal is not satisfied,” the document says.

The story of CloudPayments began a little over a year ago, when Tinkoff bought 5% of the service that belonged to Spiridonov. The businessman first claimed that he did not receive money for his share and then adjusted the claims, pointing out violations by assessing the 5%.

Spiridonov, according to him, more than once requested financial documents from the company to verify the correctness of the assessment of his participation, but did not receive the materials in the required quantity. Then the businessman went to court.

Since the beginning of the process, the plaintiff has received several denials of his claims in courts of different instances. In May, the Moscow Arbitration Court rejected Spiridonov’s request, citing the fact that by requesting the documents, the plaintiff was no longer a shareholder and therefore had no right to receive them.

Spiridonov appealed the decision, but it was again rejected by the appeals court. In August, the court decided not to accept Spiridonov’s complaint. The businessman’s representative stated that the objective of the defense continues to be “to achieve a fair judicial decision.”

The CloudPayments payment service was launched in 2014 by Dmitry Spiridonov and Konstantin Yan. Three years later, Tinkoff decided to acquire control of the company. In 2019, the group increased its share to 90%. Konstantin Yan abandoned the project and sold 5% of it. The remaining 5% belonged to Spiridonov until January 2023.
