The California Department of Motor Vehicles filed a complaint against Tesla in October 2022 that the company marketed Autopilot as a fully autonomous driving feature rather than an advanced driver assistance system (ADAS). Lawyers said that the advertisement was not misleading, criticism against the company was a violation of freedom of expression, and therefore the case was not legally valid.

The U.S. National Highway Traffic Safety Administration (NHTSA) is also investigating whether Tesla’s marketing of Autopilot increases safety risks by causing drivers to rely too heavily on the system’s abilities.

“These laws and regulations applied to Tesla in this case are unconstitutional… because they improperly restrict Tesla’s ability to tell the truth, not to mislead, about its vehicles and features,” Tesla’s lawyers said.
