On March 5, 2024, the Arbitration Court of the Moscow Region will consider the claim of the Federal Tax Service on the invalidation of the transaction on the transfer of 12.9 billion rubles between the Russian company IKEA Torg and Fami Limited (associated with IKEA). Kommersant and RBC drew attention to the case in the court file. The tax service submitted it on February 1, 2024, the amount of claims was 12.9 billion rubles, their composition was not specified.

The court ruling states that the Federal Tax Service must provide documents justifying its legal status, and IKEA Torg – an agreement on a credit line and documents under a contract for the supply of consumer goods in favor of Market.Trade LLC (owned by Yandex and owns the trademark “Yandex Market”).

We also need documents confirming settlements under credit line and supply agreements, all payment data on the transfer of funds under agreements and instructions from IKEA Torg to Market.Trade.

The interlocutor of RBC said that in the ruling of the arbitration court on the acceptance of the claim only Fami Limited is indicated, although “at least two parties are involved” in the transaction.

Alexander Erasov, partner and head of the tax disputes practice at MEF LEGAL, explained to Kommersant that the claim may be related to the fact that the Yandex structure did not pay for the goods to the Russian subsidiary of IKEA, but transferred the funds directly to the foreign family limited.

Swedish retailer IKEA closed stores in Russia in March 2022 and the company subsequently announced the sale of its factories in the country. In spring 2023, IKEA sold its last business in Russia. The buyer of the plant in the Novgorod region was the St. Petersburg company Slotex. Previously, a Komi wood processing company bought two other IKEA production plants.
