The petitioner company, which is the copyright owner of the Ultraman characters, signed an exclusive licensing agreement with the defendant company. However, in the course of providing AI rendering services, the defendant company produced images that were substantially similar to the Ultraman characters.
During the hearing, it was determined that the images created by the defendant company’s artificial intelligence were very similar to the original Ultraman characters. The court awarded $1,380 in damages for economic damages, including evidence costs.
This decision is considered representative and innovative in Chinese jurisprudence.
