Baltika again went to court to demand the recovery of funds from the Carlsberg Group structures. This time the amount of needs is 84.1 billion rubles. These are losses that a company may have incurred due to the payment of dividends or the transfer of trademark rights.

At the beginning of the month, Baltika, which is under the temporary management of the Federal Property Management Agency, filed a lawsuit against Carlsberg for 4.4 billion rubles. According to the lawsuit, this amount is made up of debt and interest for the use of the loan.

The Carlsberg Group, for its part, is still trying to challenge the court decision regarding Baltika’s use of the group’s brands, whose license the manufacturer revoked in October last year.

Now Baltika appealed to the Arbitration Court of St. Petersburg and the Leningrad Region and asks to recover 84.1 billion rubles from Carlsberg structures (Carlsberg Breweries A/S, Carlsberg Sverige Aktiebolag, Carlsberg Deutschland GmbH and Hoppy Union LLC) . The last three structures have shares in Baltika.

The court dismissed the lawsuit and asked the plaintiff to justify the need to involve the Federal Property Management Agency in the case.

As Vyacheslav Kosakov, managing partner of Novator Legal Group, suggested in a comment to the Kommersant newspaper, paying dividends in a difficult economic situation may indicate dishonesty or abuse.

According to Alina Akinshina, general director of Patents Online, Baltika’s requirements may be related to a trademark license.

Since July 2023, Baltika has been under the temporary management of the Federal Property Management Agency. The structure was transferred to the federal body along with the business of the French manufacturer Danone by order of Vladimir Putin.

However, in March, Danone’s assets were removed from the control of the Federal Property Management Agency and a deal is now being negotiated to sell the business to Vamin Tatarstan and the vice president of the Chechen government, Yakuba Zakriev.
