“The creditor of Pro Factor LLC intends to go to court with a lawsuit to declare the debtor Wildberries LLC bankrupt (April 17, 2024),” the fact says.

The message was later canceled for “illegal disclosure of personal data.”

The Wildberries press service told RB.RU that they consider the publication of messages about bankruptcy before finishing the consideration of the case as an unfair practice of putting pressure on the other party to the conflict.

“Wildberries intends to file an appeal in the case and has already deposited the amount recovered by the court decision to date in the deposit of the Moscow District Arbitration Court,” said a representative of the press service, adding that “the company’s financial situation is stable, there are no indications of insolvency or insufficient assets.”

A separate economic dispute cannot affect the digital platform’s fulfillment of its obligations to partners, Wildberries concluded. At the same time, the company refused to reveal what kind of dispute they were talking about.

In the file of arbitration cases, RB.RU editors found information about the Pro Factor LLC versus Wildberries LLC case from September 2023.

From the documents of the case it follows that the Arbitration Court of the Moscow Region fully satisfied the claim, the plaintiff of which was Pro Factor LLC and individual entrepreneur Timur Khubulov. According to the case materials, the individual entrepreneur managed to recover 156.9 million rubles for lost goods from the market.

Wildberries filed an appeal, but on April 17 the Tenth Arbitration Court of Appeal confirmed the decision without changes and the appeal was not satisfied.

What legal practice exists in such cases?

Irina Egorova, head of corporate and tax practice at law firm Intercession, disagrees that Pro Factor’s actions are unfair practices.

“This is absolutely normal practice. The court decision has come into force and there are every reasons to declare bankruptcy. Very often, in this way debtors are encouraged to pay their debts more quickly,” said the expert.

According to Egorova, the basis for filing for bankruptcy can be a debt of more than 300 thousand rubles, which has existed for more than three months.

“Taking into account the level of the company and its turnover, I doubt that this debt will not be paid. Maybe they will reach some kind of amicable agreement,” Egorova concluded.

  • In January, Pro Factor also attempted to declare the Russian legal entity Hewlett-Packard Enterprise bankrupt through the courts. At the same time, the lender has already attempted to bankrupt the server and storage system manufacturer in December 2022.
  • “Pro Factor” appeared in October 2016. The company is a plaintiff in 370 cases for a total amount of 8.7 billion rubles.
