Yandex wants to sue a Far Eastern company for the right to the Open Kitchen trademark. A year ago, the corporation began publishing a magazine of the same name.

Yandex LLC filed a lawsuit with the Court of Intellectual Rights against the company M9 Studio LLC, owner of the Open Kitchen brand. “Yandex” demanded early termination of its legal protection in relation to all services of classes 35 and 41 of ICLG, the trademark of which is registered with Rospatent, due to their lack of use.
We are talking about product demonstrations, organization of exhibitions and fairs for commercial, advertising and cultural purposes, holding congresses, conferences, educational forums, seminars, contests, shows, television and radio broadcasts.
In 2023, Yandex Food began publishing the Open Kitchen magazine about the food and restaurant phenomenon, but it turned out that such a brand was not assigned to the company in Rospatent for a number of services. The “Open Kitchen” trademark, including the spelling “OK!”, was registered by M9 Studio LLC (Blagoveshchensk) in 2018. Yandex began negotiations with the owner of the sign, but after two months it could not discuss all the details and submitted a demand, the press service of Yandex Food informed RB.RU.
“M9 Studio has not used the Open Kitchen brand for several years, so we began negotiations with the company regarding ownership conditions. This is normal practice: according to the law, if the owner does not use the trademark for three years, its legal protection can be canceled. Two months are given for negotiations, but during this time not all details were discussed. To complete the process on time, the interested party in the trademark can file a claim. This is just a legal formality to continue negotiations,” the Yandex Food press service told RB.RU.
The company did not specify how it would get rid of the brand if it won the lawsuit. It is unknown if it will be just a magazine or if Yandex has other plans to develop the brand. The request before the court has so far remained without progress for formal reasons that must be resolved before June 28.
