The complaint alleges that OpenAI’s hiring, firing and confidentiality agreements could penalize employees who report issues to federal authorities. The letter also alleges that OpenAI requires employees’ permission to disclose information to regulators, with no exceptions for reporting securities violations to the SEC.

Senator Grassley emphasized the importance of whistleblower protections in the rapidly evolving AI landscape, saying OpenAI’s policies could prevent employees from making “protected disclosures.” The whistleblowers have called for the SEC to review all contracts that include confidentiality agreements and fine OpenAI for each improper agreement.

OpenAI has not yet responded to requests for comment.
