The Government Committee on Legislative Activities has supported amendments to the Code of Administrative Offences drawn up by Rospotrebnadzor after the outbreak of botulism. The draft provides for an increase in fines for failure to notify at least twice about the start of business activity, Vedomosti has learned.

The bill includes changes to the articles on the limitation period for assuming administrative liability (Article 4.5 of the Administrative Code) and the amount of fines for violating the procedure for reporting the start of a business activity (Article 19.7.5-1 of the Administrative Code).
According to the document, fines for violating the procedure for notifying the start of business activities will increase by 145% in line with the inflation rate from 2010:
- For civil servants, they can increase from 3-5 thousand rubles to 7-12 thousand rubles;
- Individual entrepreneurs will be subject to the same fines as public officials;
- For legal entities, fines will increase from 10-20 thousand rubles to 24-48 thousand rubles.
Fines for providing false data will also be increased: for legal entities – from 20-30 thousand rubles to 24-48 thousand rubles, for officials – from 5-10 thousand rubles to 7-12 thousand rubles. The bill also provides for higher fines for repeated violations.
Other amendments suggest increasing the limitation period for claiming administrative liability for violation of the notification procedure from three to six months.
The explanatory note states that in 2021, due to the statute of limitations, 31% of the cases provided for in art. 19.7.5-1 Code of Administrative Offences, in 2022 – 33 of 134 cases (25%), in 2023 – 20%, 32 of 158 cases.
Rospotrebnadzor said that in some cases, commercial entities on whose premises violations were recorded did not report the start of their activities.
In mid-June, an outbreak of botulism occurred in Moscow and other Russian regions. More than 300 people sought medical help at the hospital. Poisoning was diagnosed in those who consumed “Lobio Salad” or “Tuna, Bean and Apple Salad” from “Cocina Local” (the “Cocina de la Zona” brand) and “Gastroport”. Criminal proceedings have been initiated against four people, all of whom have been arrested.
