Wildberries’ press service claims that the legal protection of the trademark was carried out in violation of legal requirements, which means that the trademark should be declared invalid. Among the reasons: the registration of a trademark, which is contrary to the public interest, the principles of humanity and morality, as well as the ability of a trademark to mislead consumers about the manufacturer of the product or the person providing the service.
It is known that it was registered just over a year ago in the International Classification of Goods and Services (CIGS) classes for the sale of certain goods. The entrepreneur was forced to change the brand and the product began to be launched under a different name.
The woman said that Wildberries’ algorithms have long banned them from placing internal advertising on the marketplace and also reject articles on WB Guru that mention the brand’s products.
“And all because the “WBnuty” brand seemed incorrect and unacceptable to Wildberries. And this despite the fact that the WBnuty brand is patented and has all the necessary documents from government agencies,” he said.
She also says that she has no intention of competing with the market and that she has no malicious intentions. According to her, Rospatent has carried out inspections and “adopted an appropriate position.” Kashcheva also points out that the letters “WB” are not registered at all and cannot be registered because they are not protected trademarks, as they are letters of the alphabet.
