The court approved the dismissal of the former Renault dealer’s lawsuit against the French consortium

On September 2, the Court of Appeal rejected the plaintiff’s claim against the decision of the Moscow Arbitration Court, which was adopted in the spring. It has now entered into legal force.

The lawsuit against French Renault SAS is dated October 2023. In it, the plaintiff demanded the recovery of about 12 million rubles of actual damages and about 522 million rubles of lost profits. The injured party argued that actual damages are understood as the costs of re-equipping dealerships to Renault standards and “compliance with other standards,” as well as “staff training costs.” And lost profits are the lost profits from unsold new and used cars after the closure of the Moscow plant in 2022.

Explaining the reason for the refusal, the court said that the expenses that the plaintiff considered to be actual damage had already been paid for themselves, and “RTDS still continues to use in its activities the property on which the funds were spent.” The court found that the company did not receive damages in the form of lost profits, as the dealership “replaced Renault cars with cars from Chinese car manufacturers and is currently successfully selling them.”

VTB Bank has also filed a claim with the Moscow Arbitration Court seeking to recover more than 2 billion rubles from 71 companies that are part of the Pharmacy from Warehouse pharmacy chain.
