The appeal court, following a lawsuit from the Rospotrebnadzor Office for the Astrakhan region, the Moscow City Court, declared illegal “the inclusion in the contract of air transportation of the passenger’s automatic consent to the provision of additional paid services.” This means that Pobeda Airlines is now prohibited from automatically checking boxes in the passenger insurance contract.

In 2023, the Rospotrebnadzor Office for the Astrakhan Region filed the first lawsuit against the airline before the Shcherbinsky District Court of Moscow. And then the trial court ruled in favor of Pobeda Airlines LLC.

The department was denied protection to “an indefinite number of consumers” against “the imposition of insurance contracts when purchasing airline tickets remotely” on March 22, 2023. To which the department filed an appeal with the Court Moscow Municipal.

By decision of August 22, 2024, the imposition of additional paid services by Pobeda “through a previously marked box in the contract” was declared illegal and came into force on November 8.

Kommersant recalled that in 2023 the Central Bank strongly recommended that airlines deactivate all automatic checkboxes when issuing tickets online. And in 2020, aggregator Aviasales banned airlines from including additional paid services by default in ticket orders on its portal.

In May 2024, the United States imposed sanctions against Pobeda, citing the company’s activities “in a sector of the Russian economy intended to support the military-industrial base.”
