The FAS message notes that Russians can choose to receive postal items from government agencies electronically using State Services, and the possibility of checking the presence of such consent of the recipient is possible only through the information system of JSC Russian Post.

According to the department, Russian Post limited the access of private postal operators to its information system, in particular, it did not include a clause on the delivery of letters from authorities in electronic form in the standard form of an exchange agreement between operators . This practice, according to the FAS, violates the interests of other participants in the postal market, since Pochta’s competitors were not aware of the subscriber’s consent or disagreement to receive emails.

The Antimonopoly Agency issued an order to eliminate violations of the law. It is also reported that the FAS will hold Russian Post accountable under Article 14.31 of the Code of Administrative Offenses “Abuse of dominant position in the product market.” This article provides for the imposition of a fine of 0.01% to 0.15% of the offender’s proceeds from the sale of goods on the market in which the administrative offense was committed.
