Lawyer Alexey Avanesyan drew attention to the unusual phrases that are uncharacteristic of the texts of the court decision: “a whole galaxy of defenders” – lawyers, “miraculously” – the participation of the defendants in the checks, “territorial control is perfectly organized and approved by order of the Main Directorate of the Ministry of Internal Affairs of the Krasnodar Territory.”
Linguistic analysis revealed a mixture of styles and unnatural expressions, indicating the possible involvement of artificial intelligence in the creation of part of the text.
However, the Krasnodar Regional Court rejected the complaint, confirming the legality and validity of the original decision. The district court noted that “the use of artificial intelligence in justice is not regulated in any way.”
Avanesyan said that he is not against the use of artificial intelligence in writing judicial acts in principle, but it is not yet clear how exactly the process should be structured. “Unfortunately, we have not yet received a direct answer to this question, but today many people are waiting for it. I, perhaps, support neural networks to make decisions, because in this case they will not be able to avoid considering all the evidence, accept inadmissible evidence, ignore obvious inconsistencies and contradictions in the case, put aside the testimony of witnesses, expert opinions, etc. Artificial intelligence could not do this, but a person could. But then Avanesyan emphasized that the neural network must write the sentence from beginning to end, so that the person does not have the opportunity to remove objective “inappropriate” parts from there.
