The company’s lawyers from Vladivostok are sure that “delicious” is a weak semantic element, since the word is descriptive and is often used to refer to organizations in the service sector. And the phrase “and period” is a strong semantic element. “For the average consumer, these designations will generally be associated with one another,” the claim says.

Eda i Tochka offered various options to solve the problem, including the withdrawal of the applications for registration of the Tasty – and Tochka trademarks and the complete rejection of their use or the conclusion between the parties of an agreement, for example, on the coexistence of brands. .

In June, the residents of Vladivostok were the first to notice the similarity of names. “Food and Point” has been operating since 2018, the name “Food and Point” is registered as a trademark in 2020. The company has staff, workshop and 20 branches.

The first fifteen companies of the former McDonald’s restaurant in Russia began operations on June 12 under Vkusno, and that is the key brand. Globally, everything in the network will remain as before: automatic distribution, kiosks, cafes, delivery.
