CJSC Croc Incorporated, operating under the Croc brand, filed a lawsuit to declare the Russian structure of Oracle – Oracle Computer Equipment JSC – bankrupt. The company is trying to collect the debt under a 2021 contract.
According to the file of the arbitration cases, the document was filed with the Moscow Arbitration Court on December 26. No other details of the case are given.
In the summer, Croc filed a lawsuit against Oracle in Russia, in October the court ruled to recover 47.4 million rubles from the defendant for “unjust enrichment” under a technical support agreement. The contract was concluded in August 2021, but was never executed, according to court materials.
“We were forced to go to court and the claim was satisfied in its entirety. However, after that, the payment did not follow, and therefore we are forced to take the next step, which is used in legal practice. This is a standard scenario for the development of debt collection processes with similar circumstances,” the IT company’s press service told RB.RU.
They also added that Krok “made several attempts to resolve the issue, but this yielded no results.”
Oracle suspended work in Russia from March 2022.
Croc is one of the largest system integrators in the Russian Federation and also provides technical support services for equipment and software solutions from various Russian and foreign vendors.
In October, Megafon also decided to initiate the bankruptcy of the Russian structure of Oracle. The company, as in the case of Croc, fails to comply with the court ruling that has entered into force to recover the amount for breach of contract.
