The furniture store that forced a former employee to record dance videos for TikTok will have to do it. to reimburse him R$12,000. The conviction was announced last Saturday (15) by Judge Fabrício Lima Silva of the Teófilo Otoni Labor Court in Minas Gerais.

The former employee, who was married and pregnant at the time of the posts on the short video app, said that the content created for the store’s promotional activities put him in an embarrassing situation. After leaving the job, he filed a lawsuit for compensation.

In her request, the woman claimed that her image was inappropriately displayed in videos with “attractive content”. The author also said that he didn’t feel comfortable making the recordings and that he eventually got into “laughter” as he participated in the elaboration of the material.

In the decision, the judge stated that “the publication of videos on TikTok, some with sexual connotations, some with double meanings, Estimating the neutrality zone of the image right, which may include common situations of the employment contract”. With that in mind, he ordered the store to compensate the former employee.

Defense asserts employee consent

Trying to defend itself against the conviction, the store stated that the collaborator at the time would verbally participate in recording the videos for TikTok, but did not provide evidence. For the judge, the content should not be published even with the woman’s consent.considering the “unbalanced” relationship between employer and employee.

Its defenders also claimed that the videos are non-commercial, produced for the owner’s profile and not for the company’s official account on the platform. However, Lima Silva stated that the oral evidence produced by the store itself contradicts this thesis.
