Mandatory use of the “Atesta CFM” platform for the issuance and verification of health certificates Suspended by the Federal Court. The online system created by the Federal Medical Council (CFM), aimed at reducing fraud, was scheduled to be launched on Tuesday (05).

In the decision, which followed action by the Digital Innovation Movement, reserve federal judge Bruno Anderson Santos said: He commented that CFM went beyond its competence in anticipating the service requirement. The judge was aware that this had to be determined by bodies such as the National Health Surveillance Agency (Anvisa) and the Ministry of Health, among others.

According to Santos, this mechanism could also lead to over-concentration in the market and eliminate physical medical certificates and prescriptions. It also mentions the possibility of weakening the processing of patients’ personal data, which is necessary for the creation and verification of the online certificate.

The authors of the action object to one of the Council’s justifications for mandating Atesta CFM. Those responsible for the platform claimed that this could contribute to reducing the number of fake certificates in Brazil, but the Movement claims that the data presented is insufficient to prove such fraud.

CFM will appeal the decision

The Federal Medical Council (CFM) said in a statement that it had developed the platform on a legal basis, objected to the suspension of the official system for issuing medical certificates, and was preparing to appeal the court decision.

“The institution is in the process of developing Atesta CFM, He acted on the basis of his legal authority and with full respect for the principles governing public administration. and the General Data Protection Law (LGPD).

“In addition, it does not imply any monopoly initiative as it allows integration with other platforms that doctors already use,” he said.

CFM also reiterated the importance of the mechanism to combat fraud in medical documents and increase the security of patients, healthcare professionals and employers by allowing real-time verification of the authenticity of the certificate.
