The Dolphin team says they do not think the emulator is in legal danger, although it is disappointed that it has not been released on Steam. They claim that only a small part of their code is bypass related and that their emulators are mostly used for legitimate purposes such as home software development and game mods.
While the team acknowledges the possibility of the Wii interpreting the law to circumvent drive encryption, it believes the inclusion of the Wii’s preshared key in the code should not affect legal analysis. They argue that their legal position is very strong and that the DMCA exceptions for reverse engineering for compliance speak in their favour.
Despite the failure, the Dolphin emulator will continue to evolve and include new features. Interestingly, other emulators like RetroArch and 3dSen are still available on Steam.
