Reuters reports that the International Trade Commission has issued an order according to which Apple has allowed the Apple Watch to be imported into the US.
The decision stems from the Masimo v. Apple case, in which the court ruled that Apple was guilty of infringing patents on a blood breath measurement patented by Masimo. The technology was added to the Apple Watch Series 6 in 2020.
The ITC has not made it clear that it has banned all Apple Watches, applying blood oxygen level guidelines, or just the Series 6.
One way or another, the order itself has not yet entered into force. Within 60 days, the US presidential administration must either issue an order or veto it. Apple has the right to appeal to overturn the ITC’s decision.
An Apple spokesperson said that “Macimo wrongly tried to use ITC to keep life-saving products safe from millions of American consumers, giving way to its normal watches that copy the Apple Watch.” Masimo’s spokesman said that “even the world’s largest company is not above the law.” [9to5]
