The developer and manufacturer of electronic products Aquarius filed two lawsuits with the Moscow Arbitration Court against the distributor MKT (part of the Fplus holding). The total amount of claims amounted to 108.1 million rubles, Vedomosti learned.

There are no case documents in the public domain. An Aquarius representative stated that “the claims are of a purely operational nature and relate to MKT’s failure to fulfill its obligations under the supply agreements concluded between PC Aquarius and MKT in 2023.” Fplus did not comment on the process.

According to one of the publication’s interlocutors, the lawsuit is related to the fact that MKT supplied Aquarius with low-quality products. For this reason, Aquarius submitted comments about the delivery, which were eliminated, “but not completely.”

The publication’s second source claims that MKT supplied Aquarius with products purchased from Highscreen (a registered trademark of the Russian company Vobis Computer).

Last year, Aquarius ran into financial difficulties and Marvel helped close the box office gap by purchasing Highscreen products. Under the terms of the agreement, the merchandise would later be purchased by Aquarius. However, it was in the distributor’s warehouse for a year and Marvel had to force his partner to buy it back. After the rescue, Aquarius recognized that the product was of poor quality and is now trying to return the money through the courts, the interlocutor said.

The founder of the Future Legal law firm, Pavel Katkov, explains that the litigation will be regulated according to the provisions of the Civil Code on delivery and contract. The court will order an examination. The plaintiff has probably already performed a quality assessment if he filed a claim for a defective product. Now the defendant will have to refute the plaintiff, challenge the examination, rely on the contract: did the plaintiff not meet the deadlines, did he comply with the rules of storage and operation, etc.?
