The majority of fines were imposed by four big players: Delimobil (31% of cases), Citydrive (29%), BelkaCar (21%) and Yandex.Drive (7%). The remaining 12% of cases involved challenging fines from lesser-known companies.
“If we look at the archive of the Moscow City Court, we can see that in Moscow alone Yandex.Drive participated in the courts in 6,759 cases, BelkaCar in 1,910 cases, Delimobil in 1,769 cases and Citydrive in 417 cases. The situation is similar in other regions,” DestraLegal.ru reported.
Drivers mainly resort to fines for mistakenly damaging the car and transferring control to a third party; These fines are often assessed unfairly and their amount often exceeds 100 thousand, the legal service believes. The average fine for the complaints examined was 158 thousand rubles.
The legal service analyzed the reasons for collecting fines based on Delimobil data and named the main ones:
- damage to the car, including as a result of an accident through the fault of the user – from 95 thousand rubles, as well as 40% of the amount of damage caused;
- disabling or damaging the car’s satellite geolocation equipment (GPS tracker) – 150 thousand rubles;
- drift – 110 thousand rubles;
- transfer of control of the car to a third party – 55 thousand rubles;
- applying stickers and markings to the interior or body of a car – 5 thousand rubles for each case.
According to the law firm, most of the time drivers can challenge a ticket for a no-fault accident, formal violations without proven damage, and a “ticket for ticket.” About 40% of cases are resolved at the claim stage, the rest are already in court, DestraLegal.ru clarified.
According to data from the GIS “Accounting (financial) reporting” referred to by the service, in 2023 “Delimobil” (also known as PJSC “Carsharing Russia”) received fines worth 1.5 billion rubles, when the income from car rental services amounted to 19 billion rubles, “ Citydrive (registered as New Transport Systems LLC) received fines in the amount of 543 million rubles, when rental income amounted to about 12 billion rubles.
