Amid the appearance in the media that the tax authorities began to control the purchases of Russians, the lawyer gave a recommendation on what to do if the expense significantly exceeds the declared income.

The lawyer told how to act if people’s expenses far exceed the declared income

Irina Egorova, director of corporate and tax practices at Intercessia, told RB.RU that there are two options for action if expenses significantly exceed declared income.

“In case it is possible to prove the income, and it is received from taxable activities (and by status you are allowed to receive such income), it is better to declare the income. If you receive significant amounts as a gift from relatives, it is best to transfer the funds in a non-cash form so that it is possible to confirm the source of income to the tax authority or other documents indicating that the income is not subject to tax. ”, Egorova said.

According to her, the emerging practice of the additional liquidation of personal income tax for excess expenses over income “directs people to declare all income subject to tax.”

Egorova also noted that, in itself, the excess of expenses over income does not mean the emergence of a tax base for the taxpayer, however, due to the difficulty of proving receipt of income, in fact, the burden of the test is currently offset. to the taxpayer.

Previously, Life.ru reported that in March, some Russians began receiving invitations to visit the tax authority. The tax authorities offer to prove the origin of the money spent and, in the absence of evidence, to pay the tax, which in this case the inspectors of the Federal Tax Service have the right to collect additionally by calculation.
