The Federal Tax Service has proposed new conditions for initiating criminal proceedings for non-payment of taxes. The department wants to expedite this process – not wait 75 days from the effective date of the decision to bring liability based on the results of a tax audit.

The Federal Tax Service proposed to expedite the initiation of criminal cases for non-payment of taxes

The Federal Tax Service of Russia sent a proposal to the General Prosecutor’s Office to speed up the process of initiating criminal cases against tax evaders. Forbes writes about this with reference to the document.

At the moment, a criminal case for non-payment of taxes can be initiated only after 75 days from the date of entry into force of the prosecution decision based on the results of a tax audit.

The Federal Tax Service proposes not to wait 75 days and start proceedings immediately against people who have no intention of voluntarily repairing the damage caused to the budget – hiding assets and transferring profits to affiliates. To expedite the initiation of the case, inspectors must prove that the defaulter is withdrawing funds.

Currently, the investigative committee can initiate criminal cases against tax evaders only based on the results of a tax audit. Since March 2023, it is also prohibited to initiate criminal proceedings if tax debts have been paid.
