Apple Brasil, the Brazilian subsidiary of the Cupertino company, has been ordered to refund a customer the amount paid for an iPhone 11. The smartphone, which is expected to be resistant to water, splashes and dust, was damaged by the rain.
The decision was taken by the 1st Civil Panel of the Federal District and Territories Court of Justice (TJDFT). The consumer had purchased the mobile phone in September 2020. While still under warranty, the device got wet in a sudden rain in June 2021.
The user left the phone to dry but the next day found that the camera was cloudy and Face ID was no longer working. When he took it to the authorized technical service, he discovered that the warranty did not cover problems caused by moisture and he would have to pay about R$ 3,200 for the repair.
Apple says on its website that the iPhone 11 has been lab-tested and has been given an IP68 rating. It also states that the resistance decreases over time and the warranty does not cover damage from liquids. However, Judge Rapporteur Carlos Pires Soares Neto found the data insufficient.
In its decision, he said the brand did not emphasize “the quality and characteristics of the water (for example, sweet and/or salty), its depth, time and adverse conditions”. The promotional photos also convince the consumer that the iPhone 11 is water resistant in any case.

In response, Apple defended itself, alleging customer abuse, but the unanimous resolution orders the subsidiary to pay for the purchase of the iPhone 11. The mobile phone will remain with the consumer.
