Xiaomi gets a sting from the AGCM, the guarantor of free competition. l’AGCM has fined Xiaomi’s Italian division, the fine amounts to 3.2 million euros. According to the Competition and Market Guarantee, Xiaomi would have hindered theexercise of the guarantee right by consumers.

“Xiaomi – reads the note published by the AGCM – has hindered the exercise by consumers of the rights deriving from the legal guarantee on electronic products of the Xiaomi brand”.

According to the guarantor, Xiaomi has systematically apologized not to carry out repairs in the exercise of the warranty right recognized by European and Italian standards. For example, the manufacturer would have refused to cover damage covered by the warranty when it discovered other defects, including aesthetic ones. So a battery or screen problem could be fixed quickly as the back may have several signs of scratches. Evidence – claimed the manufacturer – that the smartphone would have been stored with little care and that the damage should therefore be considered accidental and therefore not covered by the warranty.

At that time, the consumer would have been obliged to also carry out repairs for damage outside the warranty, on pain of refusal of the other repair and replacement operations. “Xiaomi has subordinated performance under warranty to repairing out-of-warranty damage,” summarizes the AGCM.
