The Plenary Session of the Constitutional Court annulled a law that suspends the validity period of licenses that expire between January 1 and January 31, 2022 for up to two years.

It is an incentive in Article 11 of the Law No. 2161 dated 2021, which allows people to have additional time to renew their driving license.

The Constitutional Court, while examining a case, stated that it was unconstitutional, but postponed the entry into force of its decision, which would take effect after 20 June 2023.

The court said the above to allow people to renew their licenses and to avoid a crash in the renewal of driver’s licenses introduced in 2014.

The decision was taken unanimously and with the presentation of Judge Cristina Pardo.

The supreme court ruled in a case in which Johan Pacheco Charris argued that the suspension of license expiration was only included in Congress until the fourth debate of the bill, in which a principle called “flexible identity” was violated.

He also said that this measure is not directly related to the Law in question, which is the Regulation on Compulsory Traffic Accident Insurance (SOAT).

In this discussion, the Attorney General’s Office requested that things remain as they are, including the incentives for citizens to improve road safety through amendment, noting that the extension of the validity period of driver’s licenses was linked to the main theme of the law.
