Online retailers have called for a bill on billing penalties for leaking and adjusting user data to be delayed. In particular, it is proposed not to penalize companies for the first leak in their practice, as well as to eliminate the obligation of personal data operators to inform users that their data has reached the hands of hackers.
The Association of Internet Trading Companies (AKIT), which includes marketplaces and various online stores, sent a request to the Ministry of Finance to postpone the adoption of a bill on billing fines for companies for leaking personal data. Vedomosti writes about it.
The companies are calling for amendments to the bill. In particular, it is proposed to cancel the fines to companies for the first data leak and for those cases in which additional information is required to identify users in addition to the data leaked to the network.
In addition, ACIT believes that operators of personal data should be exempted from the obligation to inform users that their data has reached intruders, and notify this only to Roskomnadzor.
The bill on billing fines for companies for the leakage of personal data provides for the imposition of fines on companies in the amount of up to 500 million rubles for the fact of the leakage of user data.
If the attackers have obtained data on up to 10,000 people, the fine will be up to 5 million rubles, 100,000 people – 10 million rubles, 100,000 people – 15 million rubles. In the event of a repeated leak, companies face a billing penalty of up to 3% of their annual revenue; the maximum amount will be 500 million rubles.
