Patient Sarah Depoian requested intrauterine insemination and claimed Berger assured her that the sperm would come from an anonymous donor who resembled her husband. Depoian’s daughter, born in 1981, learned that Berger was her biological father, thanks to a home DNA test this year. The lawsuit alleges that Berger’s actions were intentional and that the patient would not have consented had he known.

Although Berger no longer practices, his lawyers argue the allegations have no legal or factual basis.

Depoian hopes the case will shed light on possible abuses against other unsuspecting patients.
